Avoiding the "Confrontation Call"
Arizona Sexual Abuse Defense Attorneys
Preparing You to Avoid the "Confrontation Call"
Under Arizona law, if someone has accused someone of sexual abuse (or a similar crime), the police may ask the accuser if they will agree to do a confrontation call. This involves providing the accuser with a series of questions to ask the suspect over the phone while the police record and/or listen to the phone call.
At The Law Office of Richard L. Lougee, lawyer Rick Lougee has defended individuals charged with sex crimes and sex abuse for more than 30 years in Arizona and New Mexico. Repercussions of a "Confrontation Call"
Consequences arising from a "confrontation call" are somewhat unique to Arizona, because it is a "one party consent state". That means that if one party to a phone call gives consent for the call to be recorded and listened to, it is legal for police to do so without getting consent from the other party.
Any information given during the phone call is considered a voluntary confession admissible in court — evidence often more powerful than a confession obtained by police in another manner. Once it happens, there is little you can do. Since it is difficult to suppress evidence obtained during a confrontation call, it is crucial that you do not participate in such calls and that you do not talk to the police.
Protect yourself from these calls! The questions provided by the police are designed to bring out guilt. If someone calls you and begins asking odd questions, be very careful about what you say — you are probably being investigated.
