Should I Submit to a Polygraph?

There is no real upside to taking a polygraph test when you are the victim of false allegations of sexual abuse, but there are several downsides. Results are not admissible in Arizona or most other U.S. states, but:

  • If don't pass the polygraph, then you will be presumed guilty in the minds of investigators from that day forward. Whether or not it can be used against you in court, a failed polygraph is a presumption of guilt.
  • If you do pass the polygraph, there is still little or no chance the police will drop the case, and the results are inadmissible to prove your innocence.

A suspect is supposed to be innocent until proven guilty — but when sexual abuse allegations are made, the reality is you end up proving your innocence.People can easily become emotionally distraught when they have been accused of such a horrible crime and even innocent clients aren't in any frame of mind to take a polygraph test administered by the police.

There is no good reason to put false certainty of your guilt in the mind of the prosecutor or investigator.

If a polygraph is done, it should only be done within the confines of attorney/client privilege, so that it can remain confidential if you don't pass.
